Criminal Warrant Application Filed Against Chattooga Sole Commissioner; Hearing Set for May 7
The case was heard at the annex courthouse in Chattooga County, with Chief Magistrate Judge Chad Griffin of Whitfield County presiding to avoid any potential conflict of interest.
A formal charge means it was determined there is enough evidence to accuse someone of a crime and begin the legal process. It does not imply guilt, but it does mean the matter will go through the court system for resolution.
The case will go to trial in State Court.
Simple battery, under Georgia law, is defined as intentionally making physical contact of an insulting or provoking nature with another person or intentionally causing physical harm. The penalty if found guilty of simple battery is a misdemeanor. The consequences may include confinement of up to one year and a fine up to $1000.
